{Booking Contract}
PORTRAIT PHOTOGRAPHY SERVICES AGREEMENT
When you book with P.S.Photography you are agreeing to the following.
1. SERVICES
Photographer agrees to provide portrait photography services for Client on the agreed upon date.
The session includes:
Photography coverage for approximately ___1__ hours.
The amount of images to be edited will be decided by the client after viewing and picking out the proofs at which time they will decide which package they would like to purchase.
Delivery of edited images through an online gallery via Drop Box.
After the client chooses the poses they want standard color correction and artistic editing consistent with the photographer's style.
Photographer does not give out RAW/unedited files as this would compromise their brand style.
Proofs are to be used ONLY for the client to pick out what images they would like to purchase. Any proofs saved to personal devices, printed, or displayed on social media platforms will to be deleted.
2. PAYMENT
A $25 nonrefundable booking fee will be retained to secure your date on my schedule. this $25 will go towards the final cost of the pictures.
Before any images are edited or delivered the client needs to pay the total balance for whichever package they have picked out.
Client may pay with cash, check, or venmo. If using Check the check must clear before images will be delivered.
3. CANCELLATION AND RESCHEDULING
Client may request to reschedule the session by providing reasonable advance notice.
Photographer will make reasonable efforts to accommodate a new date, subject to availability.
If Client cancels the session, the retainer will generally be retained by Photographer as compensation for reserving the date and declining other work.
If Photographer must cancel because of weather, illness, emergency, equipment failure, or another circumstance beyond Photographer’s reasonable control, Photographer will make reasonable efforts to reschedule the session. If rescheduling is not reasonably possible, Photographer’s liability will be limited to returning payments received from Client for services that were not provided.
4. LATE ARRIVAL
Client understands that arriving late may reduce the amount of photography time available. The session will ordinarily end at the scheduled time unless Photographer agrees otherwise. Be advised that late arrival will result in less images and poses to choose from.
5. WEATHER AND OUTDOOR SESSIONS
For outdoor sessions, Photographer may recommend rescheduling due to severe weather or unsafe conditions.
The decision to reschedule due to weather will be made reasonably and with consideration for the safety of everyone involved and the quality of the photographs.
6. IMAGE DELIVERY
Client is responsible for downloading and backing up delivered photographs. Please make sure and download the full resolution images and not just screen shots of the images as this will effect the image quality. Photographer is not required to permanently archive photographs after ___1___ month from delivery.
7. EDITING AND RETOUCHING
Photographer will apply professional editing consistent with Photographer’s established style.
Basic color correction, exposure adjustments, cropping, and standard retouching are included where applicable.
Extensive alterations, body reshaping, advanced skin retouching, or other special editing will not be included in image editing.
Client acknowledges that Photographer’s artistic editing style is part of the service being purchased.
8. COPYRIGHT
Photographer retains all copyrights and ownership rights in the photographs created during the session.
Client does not receive ownership of the photographs merely by purchasing the photography services or receiving digital files.
Client receives the personal-use license described below.
9. CLIENT PERSONAL-USE LICENSE
Upon full payment, Photographer grants Client a license to use the delivered photographs for personal purposes.
Client may:
Print photographs for personal/professional use.
Share photographs on personal/professional social-media accounts.
Use photographs as personal/professional profile or display images.
Make personal copies for family and friends.
Share images with any family and friends for them to print out for personal/professional use or to display on personal/professional social-media accounts.
Client may not sell the photographs, license them to third parties, enter them into commercial advertising, materially alter them, or use them for commercial purposes without Photographer’s written permission.
10. PHOTOGRAPHER’S PORTFOLIO, PROMOTIONAL USE, AND MODEL RELEASE
Unless Client opts out in writing, Client grants Photographer permission to use photographs from the session for Photographer’s portfolio, website, social media, advertising, competitions, studio samples, and other promotional purposes.
11. CLIENT COOPERATION
Client agrees to cooperate with Photographer and to communicate any relevant needs, limitations, preferences, or concerns before
12. LIMITATION OF LIABILITY
Photographer will use reasonable professional care in providing the services.
In the unlikely event that photographs are lost, corrupted, damaged, or otherwise unavailable due to equipment failure, technical failure, accident, theft, illness, or another circumstance beyond Photographer’s reasonable control, Photographer’s liability will be limited, to the amount actually paid by Client under this Agreement.
Photographer will not be liable for indirect, incidental, special, or consequential damages.
13. ACKNOWLEDGMENT
By booking, both parties acknowledge that they have read, understood, and agreed to the terms of this Agreement.
During the session client is responsible for personal belongings brought to the session.
Photographer is not responsible for missed photographs resulting from Client’s failure to cooperate and late arrival.
12. LIMITATION OF LIABILITY
Photographer will use reasonable professional care in providing the services.
In the unlikely event that photographs are lost, corrupted, damaged, or otherwise unavailable due to equipment failure, technical failure, accident, theft, illness, or another circumstance beyond Photographer’s reasonable control, Photographer’s liability will be limited, to the amount actually paid by Client under this Agreement.
Photographer will not be liable for indirect, incidental, special, or consequential damages.
13. ACKNOWLEDGMENT
By booking with P.S.Photography, both parties acknowledge that they have read, understood, and agreed to the terms of this Agreement.
